Information regarding the processing of personal data – Informative document pursuant to and for the purposes of Article 13, “Regulation (EU) 2016/679 of 27 April 2016”

In observance of “Regulation (EU) 2016/679 of 27 April 2016”, we hereby provide you with the due information regarding the processing of the personal data provided by you. This information is not to be considered valid for other websites that may be consultable via links present on the websites under the domain of the Data Controller, who is not to be considered in any way responsible for the websites of third parties. This is information also provided pursuant to Art. 13 of “Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data”. The information is also inspired by Recommendation No. 2/2001 which the European authorities for the protection of personal data, gathered in the Group established by Art. 29 of directive no. 95/46/EC, adopted on 17 May 2001 to identify certain minimum requirements for the collection of personal data online, and, in particular, the manner, timing and nature of the information that data controllers must provide to users when they connect to web pages, regardless of the purposes of the connection, as well as that provided for by Directive 2002/58/EC, as updated by Directive 2009/136/EC, concerning Cookies.

1) Data Controller, Data Processor and Place of Processing
The Data Controller, pursuant to Art. 24 of Regulation (EU) 2016/679 is DAM S.r.l. – Viale M. Gandhi 3 10051 Avigliana (TO). The processing is carried out at the headquarters and establishments of the Data Controller and at the offices of identified external subjects.

2) Types of Data Processed

  • Personal Data: any information relating to an identified or identifiable natural person, even indirectly, by reference to any other information, including a personal identification number.

  • Identifying Data: personal data which allows the direct identification of the data subject (such as, for example, name, surname, date of birth, address, e-mail address, telephone number, etc…).

  • Data Voluntarily Provided by the User: The optional, explicit and voluntary sending of electronic mail to the addresses indicated on this site and/or the compilation of data collection forms, entails the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data inserted.

  • Cookies: The site uses both technical and profiling cookies. For further details regarding these tools, please refer to the specific information (Cookie Policy).

3) Purposes of Processing for which consent is granted where required (Art. 6 and 7 Regulation (EU) 2016/679)

Personal data, voluntarily provided, will be processed for the following purposes:

  • Any requests and/or contacts and/or sending of applications to the email addresses listed on the site;

  • Registration in the “Customers” area;

  • Registration in the “Exclusive Distribution” area.

For the purpose of applying the provisions on the protection of personal data, the personal data collected through the sending of emails to the email addresses inserted on the company website will be processed in compliance with the requirements of the Regulation. In the case of spontaneous sending of applications, these will be stored for a maximum period of 1 year and processed in accordance with the EU Regulation and national directives, and if the data subject is contacted again for an interview, specific information accompanied by consent to processing will be provided.
For those who register in the “Customers” area, the requested data are necessary for sending commercial communications and for verifying the data subject’s belonging to the healthcare sector, as required by national legislation. The collected data, including explicit consent to processing, will be processed in compliance with the EU Regulation.
For those who register in the “Exclusive Distribution” area, the requested data are necessary to allow access to additional information and the stipulation of a potential future distribution contract.

4) Processing Methods – Data Retention
The processing will be carried out in an automated and manual form, with methods and tools aimed at guaranteeing maximum security and confidentiality, by persons specifically appointed for this purpose. The data will be retained for a period not longer than the purposes for which the data were collected. Data collected from sending communications to the emails present on the site will be retained for a maximum period of 10 years (with the exception of curricula vitae, whose maximum retention period is 1 year). Data collected in registration forms will be kept until withdrawal of consent and for a period not exceeding 10 years from the last contact with the data subject.

5) Scope of Communication and Disclosure
Your data, subject to processing, will not be disclosed and may be communicated to companies contractually linked to DAM, in order to comply with contracts or related purposes. The data may be communicated to third parties belonging to the following categories:

  • subjects who provide services for the management of the information system used by DAM and telecommunications networks;

  • firms or companies in the context of assistance and consultancy relationships;

  • competent authorities for compliance with legal obligations and/or provisions of public bodies, upon request.

The subjects belonging to the aforementioned categories perform the function of Data Processor, or operate in complete autonomy as distinct Data Controllers. The list of data processors is constantly updated and available at the headquarters of DAM S.r.l. Any further communication or disclosure will take place only following your explicit consent.

6) Nature of Provision and Refusal
The user is free to provide personal data. The provision of data for the request for information/quotes and for the newsletter is necessary. Any refusal to provide data for the purposes mentioned above results in the impossibility of obtaining what is requested or to use the services of the Data Controller. The data controller does not change the methods and purposes of data processing without the prior and explicit consent of the data subject.

7) Rights of Data Subjects
You may exercise your rights as expressed by Art. 16, 17, 18 and 19 of Regulation (EU) 2016/679, by contacting the data controller, or the data processor, by sending an email to dam@gruppodam.itwith the subject “Processing of personal data”. You have the right, at any time, to request access, rectification, updating, integration, erasure, restriction and objection to the processing of the data itself. Furthermore, should you deem it appropriate in relation to the processing of your data carried out by DAM S.r.l., you have the right to lodge a complaint with the Guarantor Authority for the protection of personal data. If you contact the data controller, please provide your email address, name, address and/or telephone numbers, in order to allow the correct management of the request.

8) Social plug-in
Our web pages may contain Social Network plug-ins. If you access one of our web pages equipped with such a plug-in, the internet browser connects directly to the social network and the plug-in is displayed on the screen thanks to the connection with the browser. Before using these Plug-ins, we invite you to consult the privacy policy of the same social networks, on their official pages.
